Terms of Service

1. The Service

Lendyx Advisor ("the Service") is provided by LENDYX CREDIT LLC ("Lendyx"), Ulaanbaatar, Mongolia. The Service helps financial institutions ("Institutions") answer customer messages received by their Facebook Pages through Messenger: it drafts replies from the Institution's own documents, presents them to the Institution's staff for review, and, for a limited set of routine support questions the Institution has enabled, may send an approved reply automatically. The Service also routes conversations to a human when a question is outside its scope.

2. Who these terms apply to

These terms apply to Institutions that connect a Page to the Service and to their staff who use it ("Customers"), and, in sections 5 and 7–9, to people who message a connected Page ("End Users"). By connecting a Page, an Institution accepts these terms on its own behalf and confirms it is authorised to do so.

3. What the Service is not

• It is not a credit decision-maker. It does not approve or decline loans and does not set amounts, rates, fees or terms. Every such decision is made by the Institution.
• It does not give personalised financial, legal or investment advice.
• It does not replace the Institution's duties towards its customers under Mongolian law and the rules of the Financial Regulatory Commission.

4. The Institution's responsibilities

• Keep the documents, rules and templates it provides to the Service accurate and lawful. Replies are drafted from those documents; the Institution is responsible for their content.
• Review the Service's drafts as its own communication, and keep a member of staff able to take over any conversation.
• Use the Service only for its own Pages, in line with Meta's terms and policies for Pages and Messenger, and inform its customers as required by law.
• Not ask customers for identity documents, account numbers, passwords or payment details through Messenger, and not use the Service for marketing messages that Meta's policies do not allow.
• Keep its staff accounts secure and tell Lendyx promptly about any unauthorised use.

5. Lendyx's responsibilities

• Operate the Service with reasonable skill and care and keep it available during the hours agreed with the Institution. The Service may be interrupted for maintenance, by Meta's platform, or by events outside our control.
• Process personal data as described in the Privacy Policy, on the Institution's behalf, and not use customer message content for any other purpose than described there.
• Not sell data and not use it for advertising.

6. Fees

Fees, service hours and support levels are set in the order or agreement between Lendyx and the Institution. Where no agreement exists, the Service is provided as a pilot without charge and without a service-level commitment.

7. Intellectual property

The Service, its software, prompts and models belong to Lendyx. The Institution's documents and its customer conversations belong to the Institution. De-identified corrections may be used to improve the Service as described in the Privacy Policy.

8. Liability

To the extent permitted by Mongolian law, Lendyx is not liable for decisions an Institution takes on the basis of a draft reply, for losses caused by inaccurate documents supplied by the Institution, for interruptions caused by Meta's platform or third-party networks, or for indirect or consequential loss. Lendyx's total liability to an Institution in any twelve-month period is limited to the fees paid by that Institution for the Service in that period.

9. Ending the Service

An Institution may disconnect its Page and stop using the Service at any time. Lendyx may suspend or end the Service for an Institution that breaches these terms, Meta's policies or applicable law, and may end the Service generally with 30 days' notice. After termination, conversation data is deleted or de-identified as described in the Privacy Policy.

10. Changes

We may update these terms; the current version is always at this address with its effective date. Material changes are notified to connected Institutions in advance.

11. Law and contact

These terms are governed by the laws of Mongolia; disputes are resolved by the competent courts of Ulaanbaatar. Contact: LENDYX CREDIT LLC — info@lendyx.ai.
